PURPINK GIFTS TERMS OF USE

Welcome to Purpink.co.ke. Purpink Gifts Ltd and/or its affiliates ("Purpink") provide website features and other products and services to you when you visit or shop at Purpink.co.ke. By using Purpink Services, you agree to these conditions. Please read them carefully.

1. Privacy & Electronic Communications

Please review our Privacy Notice, which also governs your use of Purpink Services. When you use Purpink Services or send emails, text messages, and other communications from your desktop or mobile device to us, you may be communicating with us electronically. You consent to receive communications from us electronically, such as e-mails, texts, or notices on this site.

2. Your Account

If you use any Purpink Service, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or mobile device. To the extent permitted by the Laws of Kenya, you agree to accept responsibility for all activities that occur under your account or password. Purpink does sell products for children, but it sells them to adults who can purchase with a credit card or other permitted payment method (e.g., M-Pesa).

3. Copyright & Trademarks

All content included in or made available through any Purpink Service, such as text, graphics, logos, button icons, images, audio clips, digital downloads, and data compilations, is the property of Purpink Gifts Ltd or its content suppliers and is protected by Kenyan and international copyright laws.

4. License & Access

Subject to your compliance with these Conditions of Use, Purpink grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the Purpink Services. This license does not include any resale or commercial use of any Purpink Service or its contents.

5. Product Descriptions & Pricing

  • Descriptions: Purpink attempts to be as accurate as possible. However, Purpink does not warrant that product descriptions or other content of any Purpink Service is accurate, complete, reliable, current, or error-free. If a product offered by Purpink itself is not as described, your sole remedy is to return it in unused condition.

  • Pricing: "List Price" means the suggested retail price of a product. With respect to items sold by Purpink, we cannot confirm the price of an item until you order. All prices are inclusive of Value Added Tax (VAT)where applicable, as per the Kenya Revenue Authority regulations.

6. Payment Methods

Purpink accepts various payment methods common in the Kenyan market, including but not limited to:

  • M-Pesa and other Mobile Money platforms.

  • Credit/Debit Cards (Visa, Mastercard).

  • Bank Transfers.

    Payment must be received by us before our acceptance of an order.

7. Risk of Loss & Delivery

All items purchased from Purpink are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier (e.g., Sendy, G4S, or our internal delivery fleet). Delivery timelines provided are estimates and not guaranteed.

8. Returns, Refunds, and Title

Purpink does not take title to returned items until the item arrives at our fulfillment center in Nairobi. In accordance with the Consumer Protection Act of Kenya, you may be entitled to a refund or replacement for defective goods. Perishable items (such as flowers and cakes) are generally non-returnable unless they arrive damaged or fail to meet the description provided at the time of purchase.

9. Sanctions and Export Policy

You may not use any Purpink Service if you are the subject of Kenya government sanctions or sanctions consistent with Kenyan law imposed by the governments of the country where you are using Purpink Services.

10. Disclaimer of Warranties & Limitation of Liability

THE PURPINK SERVICES AND ALL INFORMATION, CONTENT, MATERIALS, AND PRODUCTS ARE PROVIDED BY PURPINK ON AN "AS IS" AND "AS AVAILABLE" BASIS. PURPINK MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULL EXTENT PERMISSIBLE BY THE LAWS OF KENYA, PURPINK DISCLAIMS ALL WARRANTIES. PURPINK WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF ANY PURPINK SERVICE.

11. Disputes & Governing Law

By using any Purpink Service, you agree that the Laws of the Republic of Kenya will govern these Conditions of Use and any dispute of any sort that might arise between you and Purpink. Any dispute relating in any way to your use of any Purpink Service shall be adjudicated in the courts of Nairobi, Kenya, and you consent to exclusive jurisdiction and venue in such courts.

12. Site Policies, Modification, and Severability

We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
